Competition for 2 free tickets to the benefit concert 23.5.2024
“Melodio for Karin and Jitka”.

(the “Rules“)

A. INTRODUCTORY PROVISIONS

  1. The organizer of the competition is the MELODIO Foundation, registered office Boušova 792/25, 190 14, Prague 9, ID No. 17654564, registered under file No. N 2209 at the Municipal Court in Prague (hereinafter referred to as the “Organizer”).

  2. The subject of these Rules is to define the conditions under which the contestants may participate in the competition for 2 free tickets to the benefit concert “Melodio for Karin and Jitka”, which will take place on 23 May 2024 at 7:30 p.m. at the Fitzgerald Hotel, Vítkova 151/26, Prague 8, organized by the organizer (hereinafter referred to as the “Competition”), as well as the conditions for the selection of winners and the handover of the prize by the organizer. By entering the Competition, the Contestant agrees to these Rules and undertakes to comply with them.

  3. The Promoter hereby declares that:
    • the Competition is in no way sponsored, endorsed or administered by Facebook / Instagram and is in no way connected with the Competition;
    • Facebook/Instagram shall have no rights or obligations to entrants in the Competition.

B. TERMS AND CONDITIONS OF PARTICIPATION

  1. The following conditions must be met in order to participate in the Contest:
    • Contestant must be at least 15 years of age on the date of the contest announcement;
    • a mailing address in the Czech Republic is not required;
    • the contestant must have a personal profile on Facebook / Instagram when participating in the competition;
    • comply with the Facebook / Instagram terms and conditions for the duration of the competition.

  2. Employees of the Promoter and other persons involved in any way in the Promoter’s activities, as well as relatives of persons excluded from participation in the Competition by this article of the Rules, are excluded from the Competition.

  3. Participation in the competition is not conditional on the purchase of goods, services or the payment of any other contribution to the competition.

C. CONTEST MECHANICS AND PRIZES

  1. To participate in the Contest, you must complete an entry:
    a. Write a comment under the contest entry on the topic “What is CARGYRA”.
    b. Follow us.
    c. The number of your answers is limited to one.

  2. Contestants may enter the contest from the time the post announcing the contest is published until 10:00 a.m. on May 20, 2024. The winners will be drawn by the organizer on 21.5.2024 and announced in a post on the organizer’s Facebook/Instagram profile no later than the following day.

  3. The organizer reserves the right to exclude contestants from the competition:
    • who have been found or are reasonably suspected of breaking the rules, or
    • do not meet the conditions for participation in the competition; or
    • share vulgar, abusive, racist or otherwise inappropriate statements or posts within the competition that are
      contrary to good manners or bring the Promoter into disrepute.

  4. The competition has 2 winners, each of whom will receive the following prize: a ticket to the Melodio for Karin and Jitka event on 23 May 2024 at 7:30 pm at the Fitzgerald Hotel, Vítkova 151/26, Prague 8, worth CZK 733,-. The Promoter reserves the right to change the prize in the event that the original prize cannot be delivered to the winners for reasons beyond the Promoter’s control.

  5. The selection of winners is at the discretion of the Promoter. If a contestant who participated in the Facebook contest and was drawn and also participated in the Instagram contest and was also drawn, will only receive 1 free ticket.

  6. If a winner is drawn who is in a wheelchair due to their disability, their assistant will also receive a free ticket.

  7. After the winners have been announced, the specific winner will be identified in a reply to his/her comment, then that winner will contact the organiser as follows: write to him/her in a Facebook / Instagram message and the organiser will tell him/her how to hand over the prize. If the winner does not claim the prize by 12:00 on 23 May, the prize will be kept by the Promoter.

  8. If the winner declines the prize, the prize will be retained by the Promoter.

  9. There is no legal claim to the prize. Winners are not entitled to claim any cash or other consideration in lieu of the prize.

  10. The Promoter reserves the right to amend these Rules. The Promoter will give reasons for any change to the Rules and will notify competitors in a timely manner in the same manner as the competition was announced.

D. PERSONAL DATA, COPYRIGHT

  1. By entering the competition, the organiser is entitled to process the personal data of these competitors to the extent necessary for the competition to be held in accordance with the Rules, for the winners to be announced and for the prize to be awarded.

  2. The organiser processes the personal data of the competitors as their controller to the following extent:
    • the organizer is only entitled to process the following personal data of the contestants – name and surname, respectively Facebook / Instagram username, email and delivery address and phone number (for winners);
    • the Organiser processes personal data for the purpose of ensuring the conduct, termination and announcement of the competition in accordance with the Rules and for the purpose of subsequent communication with the winners and the delivery of the prize;
    • the legal basis for the processing is the performance of the contract (or the performance of what the Promoter has committed to in these Rules);
    • the Promoter is entitled to process the personal data of the contestants for a maximum of 1 year after the end of the contest, unless the legislation in a particular case requires a longer processing (storage) period;
    • the Organiser is only entitled to pass on the personal data of the competitors to contractual partners who cooperate with the Organiser in the competition or to contractual partners who provide marketing, IT, accounting and legal services for the Organiser;
    • the competitor has the right to access, delete, correct, restrict processing, portability and the right to lodge a complaint with the Office for Personal Data Protection (www.uoou.cz), all within the scope of the GDPR.

  3. In case the organizer wishes to use personal data for a purpose other than those specified in these Rules, e.g. to publish the name, surname and photo of the winner on its website, etc., it will ask the specific person for his/her explicit and voluntary consent.

  4. As the winning entry(s) is (are) a work protected by copyright law, by entering the competition, the winner acknowledges that he/she is the author of the entry and/or has all necessary copyright in it and consents to its use (i.e. grants the Promoter a royalty-free, time and territory unlimited licence to the entry) in this way:

    a. Publication on the Promoter’s website www.melodio.cz.
    b. Publication of posts (especially stories) on the Promoter’s social media about what competition entries have amused or intrigued the Promoter.
